In October ICANN’s President & CEO, Fadi Chehadé, announced an ambitious plan for tackling one of ICANN’s most controversial issues—WHOIS. Undeterred by the decade’s long debate, and encouraged by the WHOIS Review Team’s Report, he challenged the notion that WHOIS couldn’t be fixed, and instead suggested a fresh approach. In line with this vision, the ICANN Board approved a two-pronged strategy to adopt the WHOIS Review Team (RT)’s recommendations to fully enforce the existing WHOIS policy and to follow the SSAC’s recommendations to redefine the purpose and scope of data directory services. When complete, ICANN hopes to transform the current antiquated WHOIS system into one that is better suited for the needs of tomorrow’s Internet.

I’d like to share with you some information on ICANN’s progress on these WHOIS-related activities.

Execution of the WHOIS RT Recommendations. The Board’s November WHOIS resolution prioritized and kicked-off a series of activities throughout ICANN—involving the Board, Staff, registrars, registries, the GNSO, At-Large and other interested community members— to implement the WHOIS RT Recommendations. Highlights include:

  • Reshaping online services. Chris Gift, ICANN’s newly appointed Vice President of Online Community Services, has been tapped by Fadi to, among other duties, create an "information portal" that will be a one-stop shop for WHOIS related inquiries targeted at helping consumers understand and use WHOIS. The portal is to include WHOIS look-ups for both thin and thick registries, and links to educational materials and a compilation of WHOIS policy and provisions. This department also will build tools to statistically sample and report on WHOIS accuracy as part of a new effort to increase data accuracy and create accuracy metrics, as recommended by the WHOIS-RT. Research and planning are under way for both of these key initiatives.
  • Enhanced Contractual Framework supporting WHOIS. The WHOIS RT noted areas where existing contracts could be enhanced to better support enforcement of current WHOIS obligations, improve accuracy, and issues related to privacy services. In response to these recommendations, ICANN has proposed amendments to the Registrar Accreditation Agreement (RAA) that include:
  • ICANN Compliance efforts to enforce WHOIS obligations. The WHOIS RT offered recommendations to improve ICANN Compliance Team’s structure, communications, and enforcement of WHOIS obligations. Substantial progress has been made. Highlights include:

A more complete description of the implementation activities is contained in the table below and detailed program reporting will be regularly issued to enable the community to track the progress of these activities.

Under Development: Next Generation Data Directory Services

In December, ICANN launched a new effort to replace the current WHOIS system with a call for volunteers to serve on an Expert Working Group. After an exhaustive search, the members of the Expert Working Group were announced, and each of them brings extraordinary expertise, leadership and consensus building skills. Led by Jean Francois Baril, the Expert Working Group will start from scratch, and take a fresh look at what the ideal data directory services might be. This effort is expected to produce a model for a replacement system—referred to as the "Next Generation Data Directory Services"—that is to take into account data accuracy and access issues, while at the same time including appropriate safeguards for privacy. The outcome of the Expert Working Group is to serve as a foundation for the GNSO’s creation of new consensus policy (and requisite contract changes, as appropriate), as requested by the ICANN Board.

The Expert Working Group met for two days in Los Angeles, and met again for another two days in London, prior to convening once again in Beijing. Although the event is tailored to regional ICANN-accredited registrars and gTLD registries, a good number of observers also attended. We had almost 80 attendees in person and around 30 remote participants.

These regional events are a chance for ICANN staff and representatives from gTLD registries and ICANN-accredited registrars to meet informally to discuss topics important to our industry and business relationships. These events happen regularly and in different locations around the world. Previous events, for example, took place in Tokyo, Munich, Toronto, and Rome. It is a great opportunity to exchange ideas, learn and network.

The regional event model was introduced in 2006 as an educational opportunity for ICANN and its contracted parties to share information about registry and registrar operations within the domain name industry. The events have been largely focused on the policies and procedures registration service providers are obligated to implement and enforce as a result of either their contract with ICANN or with one another.

These regional events are distinguished from the regular international ICANN meetings in that they are not structured, for example, to influence policy development. If you are interested in the policy development and a broader interaction with ICANN stakeholders, please join the upcoming ICANN Meeting in Prague in June this year.

Модель региональных мероприятий была введена в 2006 г. как учебно-просветительская возможность для ICANN и сторон, связанных с ней договорными обязательствами, обменяться информацией по вопросам деятельности реестров и регистраторов в рамках отрасли доменных имен. В центре проводимых мероприятий находились главным образом политики и процедуры, которые поставщики услуг регистрации обязаны внедрять и соблюдать в результате заключения договоров с ICANN или друг с другом.

Эти региональные мероприятия отличаются от регулярных международных конференций ICANN в том отношении, что они, например, не предназначены для оказания влияния на разработку политики. Ces évènements régionaux représentent une possibilité pour le personnel de l’ICANN et les représentants des registres des gTLD ainsi que pour les registrants accrédités de l’ICANN de se rencontrer de manière informelle pour discuter de sujets qui sont importants pour notre industrie et nos relations commerciales. Ces évènements ont lieu régulièrement dans des endroits différents dans le monde entier. Des évènements précédents ont eu lieu par exemple à Tokyo, Munich, Toronto et Rome. C’est une grande opportunité pour échanger des idées, pour apprendre et pour travailler en réseau.

Le modèle de l’évènement régional a été présenté en 2006 en tant que possibilité éducative pour l’ICANN et pour ses parties contractantes de partager des informations à propos de l’exploitation des registres et des bureaux d’enregistrement au sein de l’industrie des noms de domaine. Les évènements ont été notamment ciblés sur l’enregistrement des politiques et des procédures que les prestataires de services sont obligés de mettre en œuvre et de renforcer suite à leur contrat avec l’ICANN ou avec une autre organisation.

Ces évènements régionaux se distinguent des réunions internationales habituelles de l’ICANN en ce sens qu’ils ne sont pas structurés, par exemple, pour influencer le développement de la politique. Si vous êtes intéressés par le développement de la politique et par une interaction plus étendue avec les parties prenantes de l’ICANN, veuillez participer à la prochaine ICANN Meeting in Prague en juin de cette année.

Si bien el evento estuvo destinado a los registradores regionales acreditados por la ICANN y a los registros de gTLD, una cantidad importante de observadores también se hizo presente. El evento contó con casi ochenta asistentes y alrededor de treinta participantes remotos.

Los eventos regionales hacen posible que el personal de la ICANN, los representantes de registros de gTLD y los registradores acreditados por la ICANN lleven a cabo encuentros informales para debatir temas relevantes para nuestra industria y forjar vínculos comerciales. Estos eventos se realizan periódicamente en distintas sedes en todo el mundo. En ocasiones anteriores, los eventos se realizaron en Tokio, Múnich, Toronto y Roma. Además, los eventos son una excelente oportunidad para intercambiar ideas, aprender y generar contactos.

El modelo de eventos regionales se introdujo en 2006 como una oportunidad de aprendizaje para la ICANN y sus partes contratadas, posibilitándoles el intercambio de información sobre el funcionamiento de registros y registradores en la industria de nombres de dominio. Los eventos se han centrado principalmente en políticas y procedimientos que los proveedores de servicios de registración deben implementar y hacer cumplir como resultado de los contratos que celebran entre ellos o con la ICANN.

A diferencia de las reuniones periódicas de la ICANN, estos eventos regionales no están estructurados, por ejemplo, para influir en el desarrollo de políticas. Invitamos a quienes estén interesados en el desarrollo de políticas y en una mayor interacción con las partes interesadas de la ICANN a participar de la próxima reunión de la ICANN en Praga que se llevará a cabo en junio de este año.

توفر ICANN محاضرات وتسجيلات جلسة سجلات ومسجلين أمريكا الشمالية التي أقيمت في لوس أنجلوس في 17 – 18 مايو 2012. ورغم أن الحدث هو مخصص للمسجلين المعتمدين من قبل ICANN وسجلات gTLD، فقد حضر عدد كبير من المراقبين أيضاً. حيث حضر حوالي 80 مشاركاً بشكل شخصي و30 مشاركاً عن بعد.

وتعتبر تلك الأحداث الإقليمية فرصة لفريق ICANN وممثلي سجلات gTLD ومسجلي ICANN المعتمدين للاجتماع بشكل غير رسمي لمناقشة وبحث موضوعات هامة حول صناعتنا وعلاقات الأعمال فيما بيننا. تتم إقامة هذه الأحداث بانتظام في مناطق مختلفة حول العالم. على سبيل المثال، أقيمت أحداث سابقة في طوكيو وميونيخ وتورنتو وروما. إنها فرصة رائعة لتبادل الأفكار والتعلم والتواصل.

هذا وقد تم عرض نموذج الحدث الإقليمي في 2006 باعتباره فرصة تعليمية لـ ICANN وأطرافها المتعاقدة لتبادل المعلومات حول عمليات السجل والمسجلين في صناعة اسم النطاق. وقد ركزت الأحداث بشكل واسع على السياسات والإجراءات التي ينبغي أن يلتزم مزودي خدمات التسجيل بتنفيذها وتطبيقها نتيجة لتعاقدها مع ICANN أو مع بعضها البعض.

ما تتميز به الاجتماعات الإقليمية عن غيرها من اجتماعات ICANN المنتظمة هو أنها لا توثر على سياسة التطوير على سبيل المثال. إذا كنت من المهتمين بوضع السياسة والتفاعل الأوسع مع مساهمي ICANN، الرجاء الانضمام إلى اجتماع ICANN في براغ الوشيك في شهر يونيو من هذا العام.

Si vous ne connaissez pas bien l’équipe en charge de la conformité contractuelle, sachez qu’elle est la moelle épinière de l’application par l’ICANN des règles négociées avec les parties au contrat.

Maguy Serad, directrice commerciale et technologique expérimentée, a été nommée Directrice en chef de la conformité contractuelle.

Mlle. Serad a plus de vingt ans d’expérience en conformité, technologie, gestion de programme et opérations de commerce international. Plus récemment, elle a occupé des postes de directrice en chef au département systèmes informatiques et aux départements estimation PU et synergie de Nissan North America, Inc.

Chez Nissan, Mlle. Serad est devenue une experte certifiée Black Belt par Six Sigma qui a conduit de nombreux projets d’organisation stratégique et dirigé des équipes pluridisciplinaires afin d’atteindre les objectifs stratégiques de Nissan. Maguy parle couramment anglais, français et arabe. Elle prendra son poste le 4 avril.

Responsable/Auditeur de conformité contractuelle

Carlos Alvarez, avocat chevronné spécialisé en droit de la propriété intellectuelle, a également rejoint l’équipe ICANN en charge de la conformité contractuelle en tant que responsable/auditeur de la conformité contractuelle.

Avant d’entrer à l’ICANN le 28 février, M. Alvarez a exercé le droit en Colombie et aux États-Unis pendant plus de 10 ans.

Alvarez a exercé le métier d’avocat en Colombie pendant de nombreuses années au cours desquelles il a dirigé et organisé des équipes pour des activités d’audit concernant le piratage de logiciel dans plus de 4 500 entreprises. Carlos est bilingue anglais/espagnol.

Remerciements à l’équipe actuelle

Je souhaiterais également remercier les membres de l’équipe ICANN en charge de la conformité contractuelle Pam Little et Stacy Burnette, qui ont coordonné et dirigé l’équipe pendant la recherche internationale du nouveau directeur du département. Je peux témoigner que depuis que j’ai commencé à travailler directement à la gestion de cette équipe l’an dernier, ils ont maintenu des standards excellents au sein du groupe en charge de la conformité contractuelle et ont pris part à la sélection des nouveaux membres de l’équipe ainsi qu’à la construction du département.

À partir d’avril, Maguy sera sous ma direction directe et elle dirigera et continuera de construire cette équipe avec tout le soutien de la talentueuse équipe de conformité contractuelle déjà construite.

Si no conoce el grupo de cumplimiento contractual, ellos brindan la base para el cumplimiento de las reglas de ICANN que se negocian con las partes contratadas.

Maguy Serad, una gestora de tecnología y negocios de mucha experiencia, ha sido nombrada Directora de Cumplimiento Contractual.

La Sra. Serad tiene más de 20 años de experiencia en cumplimiento, tecnología, gestión de programas y operaciones de negocios internacionales. Sus últimos puestos fueron cargos directivos en el Departamento de Sistemas de Información y en los departamentos de "Value UP" y Sinergias de Nissan North America, Inc.

Mientras trabajaba para Nissan, la Sra. Serad se convirtió en una experta Cinturón Negro en Seis Sigma, y lideró muchos proyectos estratégicos de la organización y grupos interfuncionales como soporte para los objetivos estratégicos de Nissan. Maguy habla inglés, francés y árabe. Asumirá su cargo el 4 de abril.

Director/Auditor de Cumplimiento Contractual

Carlos Alvarez, un experimentado abogado en la rama de la propiedad intelectual, también se une al Grupo de Cumplimiento Contractual de ICANN como Director/Auditor.

Antes de ingresar a ICANN el 28 de febrero, Alvarez ejerció de abogado en Colombia y en los Estados Unidos durante más de 10 años.

Alvarez ejerció como abogado en Colombia durante muchos años, donde dirigió equipos y auditó las actividades de más de 4.500 empresas en materia de piratería de software. Carlos habla inglés y español.

Agradecimiento al equipo actual

También quiero expresar mi agradecimiento a los miembros del Grupo de Cumplimiento Contractual Pam Little y Stacy Burnette, quienes se han coordinado para dirigir el grupo durante la búsqueda internacional del nuevo director de departamento. Puedo garantizar que desde que empecé a trabajar de manera directa dirigiendo este grupo a finales del año pasado, han mantenido la excelencia dentro del Grupo de Cumplimiento Contractual y han formado parte en la selección de nuevos miembros del grupo y en la construcción del departamento.

A partir de abril, Maguy dependerá directamente de mí y comenzará a dirigir y continuar la construcción de este grupo, con el completo apoyo del actual y talentoso Grupo de Cumplimiento Contractual ya establecido.

Отдел соблюдения договорных обязательств — это основной орган ICANN, обеспечивающий соблюдение правил, согласованных с участвующими сторонами.

Магуи Серад (Maguy Serad), опытный руководитель в технологической и деловой сферах, назначена старшим директором отдела соблюдения договорных обязательств.

Г-жа Серад более двадцати лет работает в области соблюдения договорных обязательств, технологий, управления программами и международного бизнеса. Последняя из занимаемых ею должностей — старший управляющий департамента информационных систем и отделов повышения ценности и синергии компании Nissan North America Inc.

За время работы в Nissan г-жа Серад получила «черный пояс» эксперта в области стратегии управления от Six Sigma, она возглавляла различные стратегические проекты организации и объединенные группы специалистов, решающих стратегические задачи Nissan. Магуи свободно говорит на английском, французском и арабском языках. Она приступит к выполнению новых обязанностей 4 апреля.

Менеджер/аудитор отдела соблюдения договорных обязательств

Карлос Альварес, превосходный юрист в области интеллектуальной собственности, также присоединяется к отделу соблюдения договорных обязательств ICANN в качестве менеджера/аудитора.

Перед назначением в ICANN 28 февраля Альварес более 10 лет проработал практикующим юристом в Колумбии и США.

Много лет Альварес был адвокатом в Колумбии, где возглавлял рабочие группы и координировал работу по аудиту в сфере компьютерного пиратства более чем в 4500 компаниях. Карлос свободно владеет английским и испанским языками.

Признательность действующей группе

Я хотел бы также поблагодарить сотрудниц отдела соблюдения договорных обязательств ICANN Пам Литтл (Pam Little) и Стейси Бернетт (Stacy Burnette), которые координировали работу группы во время поисков нового менеджера отдела. Я могу подтвердить, что с самого начала моей работы руководителем этой группы в конце прошлого года они поддерживали отдел в образцовом порядке, участвовали в подборе новых сотрудников и развитии отдела.

Начиная с апреля, Магуи будет подчиняться непосредственно мне и приступит к руководству отделом и его развитию, пользуясь полной поддержкой действующих талантливых сотрудников отдела соблюдения договорных обязательств.
